A Georgia woman is suing a fertility clinic after giving birth to a child who was not biologically hers due to an embryo mix-up.
Krystena Murray, 38, became pregnant after undergoing in vitro fertilization two years ago. In Dec. 2023, she delivered a healthy baby boy, only to know immediately that the baby wasn't from her fertilized eggs. The baby was Black, while Murray was White, and she had selected a sperm donor who resembled her, White with dirty-blond hair and blue eyes. Despite realising the mixup from the
clinic, Murray decided to raise the child. She nursed him, took him to doctor’s appointments and formed a deep emotional connection. The woman says the error left her 'emotionally broken' after she bonded with the baby for months, she was forced to give him up to his biological parents.
The woman has filed a civil lawsuit Tuesday against Coastal Fertility Specialists, alleging the
clinic’s negligence, which has caused her ongoing pain and anguish. “She has not seen her child ever since,” her lawyers said in the 41-page complaint.
“I have never felt so violated and the situation has left me emotionally and physically broken. I spent my entire life wanting to be a mom. I loved, nurtured, and grew my child and I would have done literally anything to keep him,” Murray told reporters during a virtual news conference.
In a statement, the IVF clinic apologized for what it called “an unprecedented error that resulted in an embryo transfer mix-up.”
Isabel Bryan, the executive director of the clinic said, “While this ultimately led to the birth of a healthy child, we recognize the profound impact this situation has had on the affected families, and we extend our sincerest apologies."
"This was an isolated event with no further patients affected. We are doing everything we can to make things right for those affected by this incident," the statement said. The Coastal Fertility Specialists operates a clinic in Savannah and also four others in neighboring South Carolina.

“The actions of the fertility clinic have come very close to destroying me, have left irreparable damage to my soul, and ultimately left me questioning whether I should be a mom or not,” the woman said.
